Position Overview

The Litigation Attorney is responsible for managing all aspects of medical malpractice litigation from case inception through resolution, including trial and arbitration. This role requires an experienced attorney with in depth knowledge of medical, legal, and regulatory issues related to professional liability defense. The Litigation Attorney develops effective case strategies, collaborates closely with trial attorneys and claims professionals, and ensures high quality, cost effective representation of physicians and healthcare providers while adhering to established defense attorney guidelines.

Key Responsibilities

Collaborate with trial attorneys to formulate discovery strategies, investigation plans, and overall case strategy

Prepare, file, and manage pleadings, motions, and other court filings as requested

Attend court appearances, hearings, and procedural proceedings as required

Ensure cost-effective work-up and overall defense of assigned cases in compliance with Defense Attorney Guidelines

Assist trial and lead attorneys with preparation of reports to Claims at all stages of litigation to ensure timely reporting and case progress

Coordinate with Claims Specialists to obtain concurrence on defense preparation and litigation approach

Prepare and respond to discovery requests and manage related case documentation

Prepare lawsuits for trial and arbitration, including case organization and evidence preparation

Respond to hotline inquiries from the Claims Department and provide litigation guidance

10

Represent CAP and MPT physicians at depositions in deposition-only cases
